Eyzee Marketplace Products – EULA
Marketplace Product mentioned in this statement is understood as addons placed by Eyzee on (https://marketplace.atlassian.com/vendors/1216230/eyzee ).
Eyzee is the licensor of the Marketplace Product and Atlassian is not a party to the Publisher EULA or this Standard EULA, as applicable.
1. Marketplace Product LICENSE
The Marketplace Product is protected by copyright laws and international copyright treaties, as well as other intellectual property laws and treaties. The Marketplace Product is licensed, not sold.
There are two types of our Marketplace Products available on the Atlassian Marketplace:
Free Marketplace Products – some of our Marketplace Products are made available at no charge. You can use it for free, no registration required.
Paid Marketplace Products – some of our Marketplace Products are free for the trial period only. After the end of this period, fees are applicable in accordance with the Atlassian Marketplace Terms of Use. The amount of the fees is specified in the price list posted on the Marketplace.
You are expressly prohibited from modifying, merging, selling, or leasing in any matter, the Marketplace Product or any portion thereof.
2. GRANT OF LICENSE
Unless you have a different license agreement signed by Eyzee your use of Marketplace Product for Jira indicates your acceptance of this license agreement and warranty.
Subject to the terms of this Agreement, Eyzee grants to you a limited, non-exclusive, non-transferable license, without right to sub-license, to use Marketplace Product for Jira in accordance with this Agreement and any other written agreement with Eyzee.
If you do not agree to be bound by this agreement, remove Marketplace Product for Jira from all of your Atlassian Jira installations.
3. COPYRIGHT
All title and copyrights in and to the Marketplace Product(including but not limited to any images, photographs, animations, video, audio, music, text, and „applets” incorporated into the Marketplace Product), the accompanying printed materials, and any copies of the Marketplace Product are owned by the owner of this Marketplace Product. The Marketplace Product is protected by copyright laws and international treaty provisions. Therefore, you must treat the Marketplace Product like any other copyrighted material except that you may install the Marketplace Product on a single computer provided you keep the original solely for backup or archival purposes.
4. TERMINATION
Any failure to comply with the terms and conditions of this Agreement will result in automatic and immediate termination of this license.
5. LIMITED WARRANTY
NO WARRANTIES.
The owner of this Marketplace Product expressly disclaims any warranty for the Marketplace Product. The Marketplace Product and any related documentation is provided „as is” without warranty of any kind, either express or implied, including, without limitation, the implied warranties or merchantability, fitness for a particular purpose, or noninfringement. The entire risk arising out of use or performance of the Marketplace Product remains with you.
NO LIABILITY FOR DAMAGES.
In no event shall the owner of this Marketplace Product be liable for any damages whatsoever (including, without limitation, damages for loss of business profits, business interruption, loss of business information, or any other pecuniary loss) arising out of the use of or inability to use this product, even if the owner of this Marketplace Product has been advised of the possibility of such damages. Because some states/jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages, the above limitation may not apply to you.
6. GOVERNING LAW
This Agreement shall be governed by the law of the Poland applicable therein. You hereby irrevocably attorn and submit to the non-exclusive jurisdiction of the courts of Poland therefrom. If any provision shall be considered unlawful, void or otherwise unenforceable, then that provision shall be deemed severable from this license and not affect the validity and enforceability of any other provisions.
